Thank you for visiting the careers section of oxy.com and your interest in Occidental Petroleum Corporation’s (together with its wholly owned subsidiaries, “Oxy”) job offerings.

 

At Oxy, we recognize and respect your privacy. Therefore, we provide this Statement (“Privacy Statement”) to inform our job applicants (“job applicants” or “you”) about how we collect, utilize, and share your Personal Information. Please read this Privacy Statement carefully.

 

In addition to the information listed below, we also collect information (i.e., through cookies and trackers) through this website in accordance with our main website’s Privacy Statement. By using our websites and submitting an application, you acknowledge the terms of this Privacy Statement, and our Privacy Statement available in the preceding link. This Privacy Statement addresses the incremental collection of information when you register or apply for a job, and does not address our practices with respect to Personal Information (defined below) that we collect when you use our website more generally, which is covered by our main website’s Privacy Statement.

 

Oxy may update this Privacy Statement from time to time and will post the updated Privacy Statement with a “Last Updated” date at the top. In case of major changes, you will be notified upon login.

Registration / Job Application


Registration is required if you elect to apply for employment and in connection with other, personalized features of the site, including but not limited to: 

  • Specified job searches;
  • Provision of job search results via email;
  • Job applications (speculative or for particular vacancies);
  • Conducting video interviews;
  • Conducting assessments;
  • Provision of onboarding support.

Your registration is voluntary, but necessary for these purposes. Your user account profile will be used to record your choices, preferences and other information (e.g., your CV/resume, contact information, etc.) provided in a particular service context.


Categories of Personal Information We Collect

 

Oxy collects information necessary to implement your search for employment with us. Certain of the information we collect may be information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a natural person, household or device, such as a real name, postal address, e-mail address and telephone number (“Personal Information”). Information that is aggregated, de-identified or anonymized is not considered Personal Information depending on the applicable privacy law. Publicly available information that is made available from federal, state or local government records, also may not be Personal Information depending on the applicable privacy law.

 

The Personal Information we collect may be provided by you directly, or we may obtain Personal Information about you automatically through cookies and trackers (see our website Privacy Statement for further information), or from third parties (i.e., your references, current or prior employers, publicly available information and places of education).

 

Depending on your jurisdiction, Personal Information can include:

  • Personal and online identifiers (such as first and last name, email address, phone number, unique online identifiers, address);
  • Professional or employment-related information collected from the recruitment and hiring processes(such as employment history, education history,interview information, CV or resume, cover letters, references, reference letters, letters of offer and acceptance, hire, start date, skills, work experience, language abilities and education information);
  • Residency, citizenship or work permit status, visa number, military status, nationality and passport information;
  • Physical limitations and special accommodations needed;
  • Where permitted by law and as applicable, the results of (i) criminal background checks; (ii) drug testing; (iii) a general background search on highest level of education obtained and employment history; (iv) Social Security number (“SSN”) tracing; (v) a national sex offender registry search; and (vi) a driving record search;
  • Information required for us to comply with laws, including at the direction of law enforcement authorities or court orders;
  • Voicemails, e-mails, and other correspondence transmitted to Oxy; and
  • Social media profile (e.g., LinkedIn) basic account information, such as name, telephone number and email address, as well as work experience and education history, if shared with us on our careers website.

Certain of the Personal Information we collect also falls under the sub-category of “Sensitive Personal Information,” as defined by applicable privacy laws. This information includes information such as your SSN, and racial and/or ethnic information. We only collect and use Sensitive Personal Information as necessary to fulfill business purposes described herein and do not use such information to infer characteristics about you.


How We Use Personal Information

 

Oxy’s recruitment teams, as well as our service providers on our behalf, collect Personal Information for the following purposes, and for other purposes, with your consent, or as permitted by applicable law:

  • Legal purposes, including to (i) comply with applicable law or respond to valid legal process; (ii) participate in adversarial legal proceedings, including litigation and civil discovery and (iii) investigate potential violations of and enforce this Privacy Statement, our Terms of Use and other policies.
  • Processing, evaluating and communication with you about your application, including checking references or your background and, subject to your consent where required, communicating with you about other jobs that may interest you;
  • Undertake other business purposes, which include:
    • Debugging;
    • Performing services (for us or our service provider) such as account servicing, processing orders and payments and analytics;
    • Oxy' s marketing and other business purposes;
    • Internal research and analytics for technological improvement and security purposes;
    • Activities to maintain and improve our business operations.
    • Verifying your eligibility to work in the applicable geography; and 
    • Complying with government-required reporting;

How We Share Personal Information

 

We may, at times, disclose Personal Information we collect to the following categories of third parties, for the purposes identified above, or with your consent:

  • Our group of companies, affiliates and related entities in accordance with this Privacy Statement;
  • With third parties to manage aspects of your relationships with us to effectuate the uses of Personal Information described in the "How We Use Personal Information" section above, including third party service providers who access Personal Information about you to perform services on our behalf, such as provide us with results of background checks;
  • With other persons who with whom you have requested that we share Personal Information;
  • In connection with or during negotiation of, any merger, sale of Oxy stock or assets, financing, acquisition, divestiture or dissolution of all or a portion of our business; and 
  • If we believe that disclosure is reasonable necessary (a) to comply with any applicable law, regulation, legal process or governmental request; (b) to enforce our policies; (c) to protect our rights or property or the security or integrity of our services or (d) to protect Oxy, users of our services or the public from harm or potentially prohibited or illegal activities.
When sharing Personal Information with third parties, we expect that they only use or disclose your personal Information as necessary for the purposes and uses described. 

 

Oxy does not sell or share your Personal Information to third parties unless we have your explicit consent.

 

European and Other Non-U.S. Data Subject Specific Information


If you are located outside of the United States and in particular, in the EEA, Switzerland, the UK, Brazil or Canada, you may have various rights in relation to the processing of your Personal Information, including:

  • Right of access. The right to access Personal Information about you that we process.
  • Right of data portability. The right to receive your Personal Information in an interoperable format.
  • Right to rectification. The right to correct any inaccurate or incomplete Personal Information.
  • Right of erasure. The right in certain circumstances to delete Personal Information about you that we process.
  • Right to object to processing. The right in certain circumstances to request that we stop processing your Personal Information.
  • Right to restrict processing. The right in certain circumstances to request that we restrict processing your Personal Information.

To exercise any of your rights or if you have any other questions about our use of your Personal Information, please send a request at the contact details specified at the end of this Privacy Statement. Please note that we may request additional information from you to confirm your identity and ensure that you are entitled to access the relevant Personal Information.


You may also have the right to lodge a complaint with the competent data protection authority (in the country where you habitually reside, where you work or where an alleged infringement occurred) if you think that the processing of your Personal Information carried out by us infringes privacy laws applicable to you. 


Legal Bases on Which We Use Your Information


We rely on the following legal bases when we process Personal Information about individuals in the EEA, Switzerland, the UK or Brazil.

  • Contractual Necessity: We process your Personal Information to have a better understanding of your profile, experience, educational background and professional work experience. It enables us to assess your suitability for one of our job offerings and determines whether we will be offering you a contract.
  • Consent: Additionally, we rely on your prior consent in order to contact you about future opportunities at Oxy. In this regard, please note that you have the right to withdraw your consent at any time (without calling into question the processing previously carried out) by sending a request at the contact details specified at the end of this Privacy Statement.
  • Legal Obligations: We also process your Personal Information to comply with the legal obligations of your country to which we are subject, namely laws, regulations, codes of practice, guidelines or rules applicable to us, and to respond to requests from, and otherwise communicate with, competent public, governmental, judicial or other regulatory authorities of your country.
  • Legitimate interests, unless overridden by your interests or fundamental rights and freedoms: Finally, we process Personal Information based on our legitimate interests,  which consist of: (i) complying with third party countries’ laws and responding to requests from,  and other communications with, competent public, governmental, judicial or other regulatory authorities; and (ii) protecting our rights, property or security and those of job applicants. Please note that you have the right to be informed about how we have assessed that it is in our legitimate interest to collect your Personal Information for these purposes. Data Transfers


Oxy is headquartered in the United States (U.S.), so your Personal Information will be transferred to the US for the purposes referred to in this Privacy Statement. By obtaining our products or services or providing your Personal Information to us for any of the purposes described above, you acknowledge and agree that your Personal Information will be transferred to or stored in the United States.


For the purpose of providing our services, we rely on certain affiliates and service providers also located in the United States, and this may mean your Personal Information may be transferred to the United States.


When your Personal Information is transferred from your country outside of the U.S., including the EEA, Switzerland or the UK to another recipient located in a country whose legislation has not been recognized by the European Commission as having an adequate level of protection (such as the U.S.), we ensure that the transfer is governed by the European Commission’s standard contractual clauses. If you would like further information in this respect, please contact us at the contact details specified at the end of this Privacy Statement. When your Personal Information is transferred from Brazil, the transfer will be governed by the European Commission’s standard contractual clauses until the Brazilian Data Protection Authority establishes standard contractual clauses.


Data Retention


We retain personal data for no longer than necessary for the purposes described in this Privacy Statement, unless a longer retention period is permitted or required by applicable law.

The criteria used to determine our retention periods include the following:

  • Our relationship with you;
  • Your choices with respect to your personal information;
  • Whether we have a legal obligation to keep the data (for example, in certain instances records of transaction data must be kept for a certain period of time before we can delete them);
  • The permissibility of retention; or
  • Whether retention is advisable in light of our legal position (such as in regard to the enforcement of our agreements; the resolution of disputes; and applicable statutes of limitations, litigation or regulatory investigation).

Security


We take reasonable precautions, including physical, electronic and procedural safeguards, to protect your Personal Information. We make reasonable efforts to maintain security on our systems. Despite our efforts, we cannot guarantee that Personal Information will not be accessed, disclosed or altered by breach of our safeguards. You should also take adequate precautions to protect your Personal Information.

 

U.S. State-Specific Privacy Rights


Residents of certain states may have certain additional rights in relation to their Personal Information, subject to certain exceptions. For example, you may have may the right—subject to exceptions and other applicable law—to:

  • Right to transparency. Businesses that collect Personal Information and are subject to the aforementioned laws have a responsibility to provide you Statement regarding (i) the categories of Personal Information to be collected; (ii) the purposes for which the categories of Personal Information are collected or used; (iii) whether such Personal Information is sold or shared; (iv) the length of time they intend to retain each category of Personal Information, or if that is not possible, the criteria used to determine that period and (v) other relevant information. This Privacy Statement contains such information; please read this Privacy Statement, as well as any additional terms provided to you at or before the collection of your Personal Information, in their entirety.
  • Right toaccess. Right to access (i) the categories and specific pieces of Personal Information we have collected about you; (ii) the categories of sources from which we have collected such Personal Information; (iii) our business purpose for collecting such Personal Information and (iv) the categories of third parties with whom we have shared such Personal Information.
  • Right to correct. Right to correct any inaccurate or incomplete Personal Information about you that we process.
  • Right to delete. Right to delete any Personal Information about you that we process, subject to certain circumstances.
  • Right to limit. Right to limit the use and disclosure of sensitive Personal Information. Because we do not use sensitive Personal Information (to the extent it is even collected) for any purpose other than to provide our products and services and do not use it to infer characteristics about you, we do not provide this right.
  • Right to opt out of “sales” and “sharing”. Right to opt out of the “sale” or “sharing” (as defined by the CPRA) of Personal Information. Although these are rights in California, i.e., to opt out of the transfer of Personal Information to third parties for monetary or valuable consideration or cross-context behavioral advertising purposes, Oxy does not “sell” or “share” your Personal Information and therefore does not provide this right.

Oxy does not discriminate against job applicants on the basis of their exercising any of their rights afforded by the CCPA and CPRA, which is further in accordance with California residents’ rights under the law.


To request access to your Personal Information or correct or delete your Personal Information, you may contact us using our contact information found at the end of this Privacy Statement.


Please specify in your request what Personal Information you would like to access, correct or delete.


We will first acknowledge receipt of your request within 10 business days after receipt of your request. We will provide a substantive response to your request within 45 calendar days after its receipt. If we require more time (up to 90 days or the permitted timeframe), we will inform you of the reason and extension period in writing.


Only you or an authorized agent (as described below) may make a verifiable consumer request related to your Personal Information.

  • How to Authorize an Agent. You may designate an authorized agent to submit your verified consumer request on your behalf, only if the authorized agent has your written permission to do so and you have taken steps to verify your identity directly with us.
  • How We Verify Your Request. To respond to your request, we must verify your identity or the authority of your authorized agent. We will only use the Personal Information provided in that context to verify your identity or the authority of your authorized agent to make the request. Making a verifiable consumer request does not require you to create an account with us. To allow us to verify your request, we will require that you provide at least two pieces of Personal Information, including your email address and phone number, we already have in our possession. We will verify your consumer request by comparing the information you provide to information already in our possession and take additional steps to minimize the risk of fraud.

Changes to This Privacy Statement


We may update this Privacy Statement periodically to account for changes in our collection and use of your Personal Information or due to updates in applicable law. If we make any material changes to this Privacy Statement, we will provide you with notice of such changes, as appropriate. For administrative changes, we may only provide indication in our Privacy Statement by updating the “Last Updated” date at the top.
